Appeal Court considers PCT refusal on bariatric surgery

Tom Condliff, aged 62 with a BMI 43 and several co-morbidities, is appealing N Staffordshire PCT’s decision to fund surgery only at BMI 50. His grounds are that refusal breaches Article 8 of European Convention of Human Rights and that his morbid weight impedes his quality of life. A ruling is not anticipated before the end of July
Simply on medical grounds N Staffordshire have broken 2 NICE guidelines in refusing the operation. With co-morbidities, Mr Condliff qualified for surgery at BMI 35 – and he is greatly in access of that. Failure to operate will probably cost NHS much more long-term if he acquires more co-morbidities. The refusal is a false economy.
